TRAVELLER LIABILITY WAIVER & ACKNOWLEDGMENT OF RISK 

IMPORTANT: BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS 
PLEASE READ CAREFULLY BEFORE SIGNING. 
 

TO: PURE NOMAD LTD AND ITS PARTNERS 

This Waiver and Acknowledgment of Risk (“Waiver”) applies to all tours, tailor-made trips, expeditions, and travel services provided or arranged by Pure Nomad Ltd, a company registered in England & Wales (Company No. 16786156, Registered Office: 124 City Road, London, EC1V 2NX, United Kingdom), and its subsidiaries, affiliates, destination management companies (DMCs), suppliers, subcontractors, service providers, contractors, guides, leaders, local agents, employees, representatives, successors, and assigns (collectively referred to as “Pure Nomad and its Partners”). 

By signing this document, I acknowledge that I have booked a tour or travel service (“Tour”) and will be participating in certain activities, services, or experiences (“Activities”) organised, arranged, or facilitated by Pure Nomad and its Partners. 

In plain terms: I acknowledge that this waiver is given to Pure Nomad Ltd and all parties involved in organising and delivering my travel services. I understand that travel carries inherent risks and I accept personal responsibility for my safety and conduct during the trip. 
 

1. DESCRIPTION OF ACTIVITIES

I understand that “Activities” may include (depending on my chosen itinerary): 

• Adventure, cultural, or community-based travel experiences; 

• Hiking, mountaineering, trekking, camping, paragliding, zip lining, horse or camel riding, cycling, boating, or 4WD off-roading/travel; 

• Transport by public or private vehicle, train, boat, or aircraft; 

• Visits to remote, high-altitude, or developing regions; 

• Wildlife viewing or encounters; 

• Participation in cultural or hands-on workshops; and 

• Other similar activities described in my itinerary or offered as optional experiences, whether by Pure Nomad and its Partners or third-party operators (including those recommended by Pure Nomad and its Partners).

2. ACKNOWLEDGMENT OF HEALTH, FITNESS & MEDICAL CONDITION

I confirm that: 

• I am physically and mentally capable of participating in the Activities I have chosen; 

• I have disclosed to Pure Nomad all relevant medical conditions, disabilities, or dietary requirements that could affect my participation; 

• I have sought professional medical advice where appropriate; 

• I understand that some Activities involve physical exertion, high altitude, or limited medical facilities; 

• I am responsible for managing my own medication, allergies, and pre-existing conditions;  

• I accept responsibility for monitoring my own physical condition and will take appropriate action if I experience any injury, illness, or concern during the Tour, including notifying my guide or seeking medical assistance when necessary; and 

• I understand that if I choose to continue participating despite any medical or physical concern, I do so entirely at my own risk and responsibility. 

In plain terms: I acknowledge that it is my sole responsibility to ensure I am fit to participate in the Activities, to disclose any relevant health information, and to take full responsibility for managing my own wellbeing and safety throughout the Tour. 
 

3. ACKNOWLEDGMENT OF RISKS

I understand and accept that travel, particularly adventure or remote travel, involves inherent and unpredictable risks, including but not limited to: 

• Personal injury, illness, infection, or death; 

• Accidents or incidents involving vehicles, animals, or equipment; 

• Adverse weather, natural disasters, or difficult terrain; 

• Altitude sickness or limited oxygen availability; 

• Delays or disruptions due to strikes, closures, or local conditions; 

• Inadequate or delayed access to medical assistance; 

• Variability in local standards of safety, hygiene, and infrastructure; 

• Theft, loss, or damage to personal property; 

• Force majeure events (natural disasters, pandemics, political unrest, etc.); 

• Becoming lost or separated from guides or other participants; 

• Acts, errors, or omissions of other participants, local guides, drivers, contractors, or third-party providers, including any negligent or careless conduct; and 

• The fact that Pure Nomad, its staff, or local representatives cannot continuously supervise or protect travellers at all times during the Tour, and that each traveller must exercise their own judgment and caution. 

I acknowledge that these risks exist even when Pure Nomad and its Partners act with reasonable skill and care. 

In plain terms: I acknowledge that travel carries inherent and unpredictable risks, and I voluntarily accept these as part of my decision to participate in the Tour. 
 

4. STANDARD OF CARE AND LIMITATION OF LIABILITY

I understand that Pure Nomad and its Partners will provide services with reasonable care and skill. I acknowledge that the full scope of Pure Nomad’s responsibilities and limitations is set out in the company’s Booking Terms & Conditions, which I have read and accepted. 

In plain terms: I recognise that Pure Nomad’s duty is to take reasonable care, not to eliminate all risk, and I accept responsibility for my own safety and decisions throughout the Tour. 
 

5. OPTIONAL AND THIRD-PARTY ACTIVITIES

I understand that certain optional or additional activities offered during the Tour may be organised by independent third-party providers. These activities are not part of my contract with Pure Nomad Ltd. I have read and understood the relevant clause in the Booking Terms & Conditions, and I accept that participation in any such activities is entirely at my own risk. 

In plain terms: I acknowledge that if I choose to take part in extra or independent activities, I do so voluntarily and at my own risk, and Pure Nomad is not responsible for those services. 
 

6. BEHAVIOUR, ALCOHOL, DRUGS & COMPLIANCE

I understand that responsible behaviour is essential for the safety and enjoyment of all participants. I agree that: 

• If I use, consume, or am under the influence of alcohol, drugs, or any substances that impair judgment before or during the Tour or any Activity, I accept full responsibility for all resulting risks, injuries, losses, or damages, including to myself, others, or property. 

• I acknowledge that Pure Nomad and its Partners cannot be held responsible for any incident, harm, or consequence arising from my consumption or misuse of alcohol or drugs. 

• I will act respectfully at all times, follow local laws and customs, and comply with the reasonable instructions of tour leaders, guides, and local representatives. 

• I understand that any illegal activity or disruptive behaviour may result in my immediate removal from the Tour, without refund, and that I will be responsible for any additional expenses arising from my actions. 

In plain terms: I take full responsibility for my actions and behaviour, including the use of alcohol or other substances, and understand that Pure Nomad cannot be held liable for the consequences of my choices. 
 

7. INSURANCE REQUIREMENT

I confirm that I hold, or will obtain before departure, comprehensive travel insurance that covers: 

• Medical emergencies, hospitalisation, and evacuation/repatriation; 

• Trip cancellation or curtailment; 

• Personal liability; 

• Loss, theft, or damage to personal belongings; and 

• Any specific adventure or high-risk activities included in my itinerary. 

I understand that Pure Nomad and its Partners are not responsible for costs or losses not covered by my insurance. 
 
In plain terms: I accept full responsibility for securing appropriate travel insurance that provides sufficient protection for all activities and potential risks associated with my trip. 
 

8. RELEASE OF LIABILITY, WAIVER OF CLAIMS & INDEMNITY

In consideration of being permitted to participate in the Tour and its Activities, I agree to: 

• Release, waive, and forever discharge Pure Nomad Ltd and its Partners from any and all claims, demands, actions, or causes of action – now or in the future – arising from or related to my participation in the Tour or Activities, including for loss, damage, injury, illness, or expense, except for any death or personal injury arising from Pure Nomad and its Partners’ negligence or breach of legal duty; 

• Waive any right to bring or pursue legal proceedings against Pure Nomad Ltd or its Partners for any loss, injury, damage, delay, or expense resulting from inherent travel risks, the acts or omissions of third parties, or events beyond their reasonable control, except for any death or personal injury arising from Pure Nomad and its Partners’ negligence or breach of legal duty; 

• Accept full responsibility for my own actions, decisions, and conduct throughout the Tour, and acknowledge that travel involves inherent and unpredictable risks that I voluntarily assume;  

• Indemnify and hold harmless Pure Nomad Ltd and its Partners from any claim, liability, or cost (including legal expenses) brought by any third party as a result of my actions, behaviour, or non-compliance with this Waiver; and 

• Acknowledge that this release and waiver are binding upon me, my heirs, next of kin, executors, administrators, and assigns, who will have no right to claim or recover from Pure Nomad Ltd or its Partners for any loss, damage, injury, or expense arising from my participation in the Activities, except for any death or personal injury arising from Pure Nomad and its Partners’ negligence or breach of legal duty. 

In plain terms: I waive any present or future right to hold Pure Nomad Ltd or its Partners legally responsible for injury, loss, or damage, and I understand that this waiver also binds my estate and next of kin. 
 

9. FORCE MAJEURE & UNAVOIDABLE EVENTS

I understand that circumstances beyond the reasonable control of Pure Nomad Ltd or its Partners – such as natural disasters, political unrest, or transport disruptions – may impact the Tour. The handling of such events, including cancellations or changes, is governed by the company’s Booking Terms & Conditions, which I have read and accepted. 

In plain terms: I acknowledge that unpredictable events can affect travel, and Pure Nomad will follow its Booking Terms when such situations arise. 
 

10. GOVERNING LAW ANDJURISDICTION

I agree that this Waiver, and any dispute arising from it, shall be governed by and interpreted in accordance with the laws of England and Wales, and that any proceedings shall be brought exclusively in the courts of England and Wales. 
 

11. CONFIRMATION AND ACKNOWLEDGMENT

I confirm that: 

• I have read, understood, and voluntarily signed this Waiver; 

• I have read and understood Pure Nomad’s Booking Terms & Conditions, Privacy Policy, and Responsible Travel guidance; 

• I have had the opportunity to ask questions before signing; and 

• I understand that I am waiving certain legal rights that I or my representatives may otherwise have. 
   

This document will be sent along with our Booking Terms & Conditions upon booking a tour or tailor-made adventure with Pure Nomad Ltd.
