Pure Nomad Booking Terms & Conditions

Please read and understand the conditions of booking set out below before reserving a tour with Pure Nomad Ltd. We also recommend reviewing the relevant information for your chosen tour on our website prior to booking to ensure you are familiar with the itinerary and type of tour you are undertaking.  

1. PURE NOMAD LTD BOOKING TERMS & CONDITIONS 
 
By booking or participating in a tour and any associated products or services (a “Tour”) with Pure Nomad Ltd (“we”, “us”, “our”), you, being the person making the booking and the first person named in the booking (“you”) agree to these Booking Terms & Conditions together with our Waiver of LiabilityPrivacy Policy, our Website Terms of Use, (if your booking is made via our website), and any other written information brought to your attention prior to confirmation of your booking (the “Terms”). The Terms form the basis of your binding contract with Pure Nomad Ltd, a company registered in England and Wales (company number 16786156), with a registered office at 124 City Road, London, EC1V 2NX. Please read the Terms carefully as they outline the rights and obligations of both parties. For the purposes of these Terms, references to “you” and “your” include the first named person on the booking and all persons for whom a booking is made, or any other person added to the booking. 

Pure Nomad Ltd is a company registered and operating in the United Kingdom. All bookings made with us, regardless of the customer’s country of residence or point of sale, are governed by and construed in accordance with the laws of England and Wales. We adhere to the requirements of the Package Travel and Linked Travel Arrangements Regulations 2018 (SI 2018/634), which implement the EU Package Travel Directive into UK law. These regulations set out your rights and our responsibilities as a tour operator. By booking with Pure Nomad Ltd, you acknowledge that any dispute, claim, or other matter arising from your booking or contract shall fall under the jurisdiction of the courts of England and Wales. For international customers, Pure Nomad Ltd acts under the same legal and regulatory standards as applied within the United Kingdom, and all services are offered and fulfilled in accordance with these standards.

2. KEY RIGHTS

Key Rights under the Package Travel and Linked Travel Arrangements Regulations 2018 

The combination of travel services offered to you is a package within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018. Therefore, you will benefit from all EU and UK rights applying to packages. Pure Nomad Ltd will be fully responsible for the proper performance of the package as a whole. 

Additionally, as required by law, Pure Nomad Ltd has protection in place to refund your payments and, where transport is included, to ensure your repatriation in the event that it becomes insolvent. 

Key rights under the Package Travel and Linked Travel Arrangements Regulations 2018: 

  • Travellers will receive all essential information about the package before concluding the package travel contract. 
  • There is always at least one trader who is liable for the proper performance of all the travel services included in the contract – in this case, Pure Nomad Ltd. 
  • Travellers are given an emergency contact number or details of a contact point where they can get in touch with the organiser or travel agent during the trip. 
  • Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs. 
  • The price of the package may only be increased if specific costs rise (for example, fuel prices) and if expressly provided for in the contract. In any event, it shall not be changed later than 20 days before the start of the package. If the price increase exceeds 8% of the package price, the traveller may terminate the contract without paying a termination fee. If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction if the relevant costs decrease. 
  • Travellers may terminate the contract without paying a termination fee and receive a full refund of any payments if any of the essential elements of the package, other than the price, are significantly changed. 
  • If the organiser cancels the package before its start, travellers are entitled to a refund and compensation where appropriate. 
  • Travellers may terminate the contract without paying a termination fee before the start of the package in the event of unavoidable and extraordinary circumstances occurring at the destination or its immediate vicinity which significantly affect the performance of the package or the carriage of passengers to the destination. 
  • Travellers may terminate the contract at any time before the start of the package in return for an appropriate and justifiable termination fee. 
  • If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem. 
  • Travellers are also entitled to a price reduction or compensation for damages or both where the travel services are not performed or are improperly performed. 
  • The organiser has to provide assistance if the traveller is in difficulty. 
  • If the organiser or retailer becomes insolvent, payments will be refunded. If insolvency occurs after the start of the package and transport is included, travellers will be repatriated. 

Pure Nomad Ltd has insolvency protection with Protected Trust Services Ltd (PTS), membership number 6409.

3. AUTHORITY AND AGREEMENT

By making a booking, you confirm on behalf of all participants that you: 

  • Have read these Booking Terms & Conditions and our Privacy Policy and have the authority to accept them on behalf of all persons named on the booking; 
  • Consent to our use of personal data in accordance with our Privacy Policy and are authorised to disclose the personal details of all participants, including special categories of data where applicable (such as health conditions, disabilities, or dietary requirements); 
  • Are over 18 years of age and, where ordering services subject to age restrictions, confirm that all members of the party meet the required age criteria; and 

  • Accept financial responsibility for payment of the booking on behalf of all persons detailed on the booking. 

4. DESIGNATED CONTACT PERSON

The first person named on the booking acts as the designated contact for all participants included in the booking. This includes being responsible for: 

  • Making all payments due in connection with the Tour; 
  • Notifying Pure Nomad Ltd or your travel agent of any changes or cancellations; and 
  • Keeping all members of the party informed. 

By booking on behalf of others, you warrant that you have obtained all necessary consents and that all information provided is accurate and complete. Pure Nomad Ltd shall not be liable for any errors or omissions in the information provided to complete a booking. 

5. ADDITIONAL TERMS

Additional terms and conditions may apply to tours we offer, in addition to these Terms, for example for specific Pure Nomad Ltd tours or travel types. These additional terms may be set out in these Booking Terms & Conditions and/or communicated to you prior to booking, for example, on the specific tour page on our website. 

6. BOOKING AND CONTRACT FORMATION

Making a Booking 
A booking with Pure Nomad Ltd is confirmed when you pay a non-refundable deposit of £200 per person (or full payment if booking within 60 days of the tour start date) and we issue a booking confirmation to you by email. We may, at our discretion, return your deposit and decline to confirm your booking. Some tours or services provided by Pure Nomad Ltd may require full payment at the time of booking. We will inform you of any such requirements before confirming your booking. 
 
Contractual Agreement 
A binding contract between you and Pure Nomad Ltd is formed when we send you a booking confirmation. This document will outline the details of your booking and will be sent to you or your nominated representative such as your travel agent. You must check all information carefully and notify us immediately of any inaccuracies. Failure to report errors within ten days of receipt may limit your rights and our ability to make corrections.  

7. INFORMATION REQUIRED FOR BOOKING
 
As part of the booking process, you must provide all information requested by Pure Nomad Ltd. This may include personal details, health information, and information required for air tickets, permits, visas, or other inclusions. We process all personal information about you, and other participants in your booking, in accordance with our Privacy Policy 
 
Responsibility for Accuracy 
You are responsible for ensuring that all information provided is complete and accurate. Pure Nomad Ltd will not be liable for any costs, losses, or missed inclusions arising from errors, omissions, late submission, or otherwise incomplete information. 
 
Consequences of Incomplete Information 
The specific details required will vary by tour and will be communicated during the booking process to you or your authorised agent. If required information is not supplied when and where requested, Pure Nomad Ltd may treat your booking – or the relevant portion of it – as cancelled and may apply reasonable cancellation fees. 
 

8. PAYMENT OF BALANCE AND ACCEPTANCE
 
The final balance for your booking or any associated products/services is due 60 days before the departure date of the first element of your booking, unless full payment was made at the time of booking. 
 
Late or Missing Payment 
If full payment is not received by the due date, costs for the tour (or elements thereof) may increase and you will be responsible for paying such increased costs.  

If you do not make full payment when it is due, Pure Nomad Ltd reserves the right, in our sole discretion, to treat the booking as cancelled, retaining any deposit paid as a cancellation fee. 

Short-Term Bookings 
Bookings made within 60 days of the tour start date must be paid in full at the time of booking. 

Special Payment Terms 
Where different payment terms apply for a specific product or service, these will be communicated to you prior to booking and detailed on your invoice. 

Third-Party Charges 
We may use third party online payment processors to collect payments via our website or other payment links provided to you (“Online Payment Processor”). By making a payment on our website or any payment link provided to you, you accept the Online Payment Processor’s privacy policy that is available here https://protectedpaymentservices.com/privacy-policy/ 

Pure Nomad Ltd is not responsible for any fees or charges applied by third parties or financial institutions in connection with your payments, including bank charges or currency exchange fees. Such charges are non-refundable. 

9. ACCURACY OF INFORMATION 

Pure Nomad Ltd endeavours to ensure that all information and prices displayed on our website are correct. However, errors and changes can occasionally occur. We therefore reserve the right to amend prices or other details where necessary. It is your responsibility to check the price and all relevant details for the tour or services you wish to book before confirming your booking.  

10. MANDATORY INSURANCE

Adequate travel insurance is a requirement of your contract with Pure Nomad Ltd. You must ensure that your policy fully covers your personal needs, including any pre-existing medical conditions, cancellation charges, medical expenses, loss or damage to luggage and personal belongings, and evacuation or repatriation in the event of accident or illness.  

If your tour includes adventure sports or other high-risk activities, or you plan to undertake such activities while on the tour (including where it is not part of the services we offer) you must confirm that these are specifically covered by your insurance. It is strongly recommended that your policy also covers cancellation, curtailment, and any other costs that may arise as a result of loss, damage, injury, delay, or other inconvenience while travelling. 

You acknowledge that travel insurance is not included in the cost of any tour offered by Pure Nomad Ltd, and you are responsible for obtaining appropriate coverage at your own expense. Should you choose to travel without adequate insurance, Pure Nomad Ltd will not be liable for any losses, damages, or expenses which would have otherwise been covered by an insurance policy. 
 
11. PRICING 

General Pricing 
Tours are priced and advertised inclusive of applicable taxes. Prior to booking, Pure Nomad Ltd reserves the right to amend the price of unsold tours at any time and to correct any errors in the prices of confirmed tours. 

Price Increases 
The price of confirmed tours may only be increased to reflect additional costs that arise as a direct result of: 

  1. Changes in the cost of transporting passengers, including fuel or other power sources; 

  2. Changes in taxes, fees, or charges imposed by third parties not directly involved in the provision of the tour, such as tourist taxes, landing taxes, or embarkation/disembarkation fees at ports and airports; or

  3. Fluctuations in the relevant exchange rates.  

Customer Contribution to Price Changes 
Pure Nomad Ltd will absorb any increase up to and including 3% of the price of your tour (excluding insurance premiums, amendment charges, or additional services). Any increase above 3% of the price of your tour will be payable by you. If you do not pay the additional costs (up to 8% of the original price paid for the tour) when required, we reserve the right to cancel your booking and retain the deposit paid.  

Significant Price Increases 
If a price increase exceeds 8% of the price you paid for the relevant tour (on a per person basis) (excluding insurance premiums, amendment charges, or additional services), you will have the option to either: 

  1. Accept a substitute tour of equivalent or higher quality at no additional cost, or a lower-quality alternative with a refund of the price difference, if we offer this to you; or

  2. Cancel your booking and receive a full refund of all monies paid to Pure Nomad Ltd, excluding insurance premiums, amendment charges, or additional services. 

To exercise this right, you must notify Pure Nomad Ltd within 7 days of the issue date printed on your final invoice.  

Price Reductions 
If the actual cost to us to provide you with the tour decreases due to the following factors, we shall pass on the benefit to you by way of a refund (if all fees paid) or reduction (if all fees not yet paid): 

  1. Changes in the cost of transporting passengers, including fuel or other power sources; 

  2. Changes in taxes, fees, or charges imposed by third parties not directly involved in the provision of the tour, such as tourist taxes, landing taxes, or embarkation/disembarkation fees at ports and airports; or 

  3. Fluctuations in the relevant exchange rates. 

Please note that some apparent changes may not affect the final cost due to contractual protections or the currency in which services are purchased.  

Discounts 
Any discount or promotional offer applied to a tour after a booking has been made will not apply retrospectively to your confirmed booking. No refund will be provided for such post-booking discounts. 

Furthermore, you may not cancel an existing booking and rebook in order to benefit from any subsequent discount, promotional offer, or reduced pricing. Any attempt to do so will be treated as a cancellation under our standard terms, and any applicable cancellation fees will apply.  

Reduced Pricing for New Bookings 
From time to time, Pure Nomad Ltd may offer reduced pricing on certain tours or services. Reduced pricing applies only to new bookings; bookings for which a deposit has already been received are not eligible for subsequent discounts. 
 
12. JURISDICTION AND APPLICABLE LAW 

These Booking Terms & Conditions, and any contract to which they relate, are governed in all respects by English law. Any dispute, claim, or matter arising out of or in connection with your booking or contract will be subject to the exclusive jurisdiction of the courts of England and Wales. 

13. CURTAILING YOUR TOUR

If you are required to return home before the scheduled end of your tour, you will be responsible for arranging at your own expense all return travel costs. Subject to any rights you have at law, Pure Nomad Ltd will not refund the cost of any unused travel arrangements. Pure Nomad Ltd will not be liable for any additional costs you may incur as a result. Depending on the circumstances, your travel insurance may provide cover for curtailment, and any such claim should be submitted directly to your insurance provider. 

14. CHANGES TO YOUR BOOKING

If you wish to make any changes to your booking after receiving our booking confirmation email, the first named person on the booking must notify Pure Nomad Ltd in writing as soon as possible. While we will do our best to accommodate your request, we cannot guarantee that changes can be made and reserve our right to reject a change request. 

Where a change is permitted by us, it will be subject to: 

  • An administration fee of £50 per person per change; and 
  • Any additional costs or charges incurred by Pure Nomad Ltd or our suppliers in implementing the change. 

Please note that these costs may increase the closer the change is requested to the departure date, so early notification is strongly advised. If we are unable to accommodate your request and you do not wish to continue with your original booking, your booking will be treated as a cancellation, and standard cancellation charges will apply. 

Date Changes 
All travellers are entitled to one free change of travel dates for bookings made more than 60 days before departure. Any subsequent date changes will incur the administration fee of £50 per person. Date changes cannot be made within 60 days of departure. If your original booking was made with a discount, we cannot guarantee that the discount will apply to a new departure date. 

Transfers of Bookings 
You may transfer your booking to another person who satisfies all conditions applicable to the tour, provided that you give Pure Nomad Ltd notice in writing at least 61 days before departure.  

A £50 administrative fee will apply to each transfer, along with payment of any difference in the tour price -including where the original booking was made at a discounted or promotional rate. 

Transfers are not permitted within 60 days of departure due to the requirement for permits, tickets, and other documentation linked to individual traveller names, which cannot be reissued or amended at short notice. 

15. CANCELLATION BY YOU BEFORE DEPARTURE

If you or any member of your party decides to cancel a confirmed booking, written notification must be sent to Pure Nomad Ltd via email at sales@purenomadadventures.com. Cancellation is effective from the date we receive this notification.

Optional add-ons such as private airport transfers, single supplements, or pre-/post-tour accommodation are considered part of the tour and the same cancellation charges apply. 

Promotional Bookings 
Once a deposit has been paid, you may not cancel and rebook within a promotional period to take advantage of discounts. Pure Nomad Ltd reserves the right to amend pricing on any new booking made during this period and may decline bookings attempting to exploit promotional offers. Where possible, cancellation charges will be deducted from any monies already paid. 

16. CANCELLATION DUE TO UNAVOIDABLE CIRCUMSTANCES

You may cancel your confirmed tour without incurring cancellation charges if “unavoidable and extraordinary circumstances” occur at your tour destination or its immediate vicinity, significantly affecting either the performance of the tour or transport arrangements to the destination. In such cases, Pure Nomad Ltd will provide a full refund of monies paid for the tour, but we will not be liable for any additional compensation. 

For the purposes of this clause, “unavoidable and extraordinary circumstances” include: 

  • War or acts of terrorism; 
  • Significant risks to human health, such as outbreaks of serious disease at the destination; 
  • Natural disasters, including floods, earthquakes, or severe weather conditions that make safe travel impossible. 

17. CHANGES AND CANCELLATIONS BY PURE NOMAD LTD

As we organise your tour arrangements many months in advance, Pure Nomad Ltd reserves the right to make changes or cancel your booking at any time. 

Minor Changes 
Where we make minor changes to your tour, we will endeavour to inform you or your travel agent as soon as reasonably possible before departure. Examples of minor changes include: 

  • Change of itinerary details, such as moving a sightseeing visit to another day; 
  • Change of transport timings, with slightly different departure or arrival times that do not affect the overall tour significantly; 
  • Substitution of accommodation with another of the same or higher standard; 
  • Minor route or logistical adjustments. 

Pure Nomad Ltd will have no liability for minor changes. 

Significant Changes 
Occasionally, it may be necessary to make a significant change to your confirmed arrangements before departure. Examples of significant changes include: 

  • A change of accommodation location for all or a substantial part of your tour; 
  • A change of accommodation to one of a lower standard or classification for all or a substantial part of your tour;  
  • A change to your outward departure time or overall duration of the tour by 12 hours or more; 
  • A significant alteration to your itinerary, including the omission of one or more destinations. 

Notification and Options for Significant Changes or Cancellation 
If a significant change or cancellation is necessary, we will inform you as soon as possible and, if there is sufficient time before departure, offer you the choice of: 

  1. Not accepting the changed arrangements and cancelling your booking without penalty – we will provide a full refund of all monies paid;  

  2. Accepting alternative arrangements of comparable or higher standard at no extra cost, if we offer such alternatives; or 

  3. Accepting alternative arrangements of a lower standard, with a refund of the price difference between the original and alternative arrangements, if we offer such alternatives.  

You must notify Pure Nomad Ltd of your choice within 7 days of our offer. If no response is received, we will contact you again. Should you fail to respond within a further 3 days, we will assume you accept the change. 

Pure Nomad Ltd will not cancel your tour within 60 days of departure except in cases of Force Majeure (as defined in clause 19) or if you fail to pay the final balance. If you fail to make the final payment by the due date, your booking will be treated as cancelled by you and your deposit will be forfeited. In cases of Force Majeure, Pure Nomad Ltd may, at its discretion, offer to hold your deposit on file for a future booking.  

Changes After Departure 
Once your tour has commenced, itinerary changes may be necessary due to unforeseen circumstances, operational requirements, or concerns for your health, safety, comfort, or enjoyment. Any such changes are at the discretion of Pure Nomad Ltd. You acknowledge that you must have sufficient financial resources to cover any incidental expenses incurred during your tour, whether or not such expenses arise from changes to the itinerary. Pure Nomad Ltd will not be liable for indirect or consequential losses resulting from any changes to your booking or itinerary. 

If we become unable to provide a significant proportion of the arrangements you booked after departure, we will, where possible, provide suitable alternative arrangements at no extra cost. Should the alternatives be of a lower standard, an appropriate price reduction will be offered.  

18. GUARANTEED DEPARTURE

While Pure Nomad Ltd strives to operate all tours as guaranteed departures, group tours are subject to a minimum passenger requirement. If a tour does not meet the required number of participants, we will notify you no later than 60 days before departure. In such cases, you will have the option to: 

  1. Transfer to an alternative date that is a guaranteed departure;  
  2. Receive a full refund; or 
  3. Pay an additional amount to upgrade to a private tour. 

You must inform us of your choice within 7 days of our offer. If we do not receive a response, we will contact you again. Should you fail to respond within a further 3 days, we will assume that you have chosen to cancel your booking. 

Please note that Pure Nomad Ltd is not responsible for any services booked by you in connection with the tour, including but not limited to insurance policies or flights to the tour destination. We strongly recommend that you only book flights and other ancillary services once we have confirmed your tour as a guaranteed departure. 

19. FORCE MAJUERE

Except where expressly stated otherwise in these Booking Terms & Conditions, Pure Nomad Ltd will not be liable to you or pay compensation if our contractual obligations are affected by events of “Force Majeure”. For the purposes of these Booking Terms & Conditions, “Force Majeure” refers to any event beyond our or our suppliers’ control, the effects of which could not have been avoided even if all reasonable measures had been taken. Examples include, but are not limited to: 

  • Warfare, acts of terrorism (or threats thereof), or civil unrest; 
  • Significant risks to human health, such as outbreaks of serious disease at the travel destination; 
  • Natural disasters including floods, earthquakes, or extreme weather conditions that make it unsafe to travel to or remain at the destination; 
  • Acts of government or other national or local authorities, including port or river authorities; 
  • Industrial disputes, strikes, lockouts, or other labour actions; 
  • Fires, chemical, biological, or nuclear incidents; 
  • Unavoidable technical issues with transport; and 
  • Any other similar events outside the control of Pure Nomad Ltd or the relevant supplier(s). 

20. SPECIAL REQUIREMENTS

Any special requests, including but not limited to dietary needs, room preferences, or specific facilities at accommodation, must be notified to Pure Nomad Ltd at the time of booking. Such requests should also be confirmed in writing. While we will make every reasonable effort to meet your requests, we cannot guarantee that they will be fulfilled. 

The fact that a special request is noted on your booking confirmation or passed to a supplier does not constitute a guarantee that it will be accommodated. Failure to meet any special request will not constitute a breach of contract unless we have expressly confirmed the request in writing. For allergy and dietary requirements, we shall not be responsible for food suppliers. Bookings that are conditional upon a special request being met will not be accepted. 

Please note that many of our tours take place in remote locations, and it may be difficult or impossible to satisfy special requests. Some tours involve staying with local families or in remote accommodation where private rooms, specific dietary requirements, or other requests may not be available. Special requests do not form part of your contract with Pure Nomad Ltd, and we accept no liability for failure to fulfil them. 
 
21. DISABILITIES AND MEDICAL CONDITIONS 

Pure Nomad Ltd is not a specialist provider of tours for travellers with disabilities. However, we will endeavour to accommodate any special requirements you may have. You must provide full details of any medical condition, disability, or other relevant health information at the time of booking so that we can advise on the suitability of your chosen tour. While we can provide information on the suitability of tours, we cannot provide medical advice. Travelling is at your own discretion, and you must ensure that you have appropriate travel insurance covering any pre-existing medical conditions. Pure Nomad Ltd is not responsible for any issues arising from failure to obtain adequate insurance or for any health-related problems that may occur during your tour. 

Pregnancy is considered a medical condition and must be disclosed at the time of booking. Pure Nomad Ltd may refuse to carry women who are over 24 weeks pregnant. We may also refuse to carry any traveller whose medical condition cannot be reasonably accommodated or for whom alternatives cannot be arranged. If we reasonably determine that we cannot safely or appropriately accommodate your needs, we may decline to confirm your booking. If you fail to provide full and accurate details at the time of booking and we later become aware of them, we may cancel your booking and applicable cancellation charges will apply. 

It is your responsibility to assess whether a tour is suitable for you. You should consult your physician or a medical professional to confirm your fitness for travel and participation in planned activities, including advice on vaccinations and other medical precautions. Travel may involve visiting remote or developing regions where medical care may not be readily available and facilities may not meet the standards of your home country. Pure Nomad Ltd makes no representations or warranties regarding the availability, quality, or standard of medical facilities at the tour destinations. 

22. AGE REQUIREMENTS

Group Tours 
Unless otherwise specified in the tour description or by Pure Nomad Ltd, the minimum age for participants on group tours is 18 years at the time of booking. 

Tailor-Made Tours 
Anyone under 18 years of age on the date of first travel is considered a minor and must always be accompanied by an adult. One adult may accompany up to two minors. Unless otherwise indicated in the tour description or by Pure Nomad Ltd, the minimum age for minors travelling on any tour is 12 years old.  

All bookings involving minors are subject to review and approval by Pure Nomad Ltd. Where applicable law requires the consent of a parent, guardian, or other authorised person for a minor to travel, the accompanying adult is responsible for obtaining all necessary consents, documentation, and ensuring that both they and the minor(s) comply with all legal requirements for entry, departure, and travel in all relevant countries and regions. Pure Nomad Ltd will not be liable for any costs, damages, or losses arising from failure to secure the required consents, permits, or approvals. 

Each adult accompanying a minor or minors is jointly and severally responsible for the behaviour, welfare, supervision, and monitoring of such minor(s), and accepts these Booking Terms & Conditions on behalf of the minor(s), including all assumptions of risk and limitations of liability. Pure Nomad Ltd does not provide care or chaperone services for minors and expressly disclaims any responsibility for supervising, controlling, or ensuring the safety of minors during the tour. 

23. COMPLAINTS

We strive to ensure that your tour arrangements run smoothly. However, if you encounter any problems during your tour, you should inform your local guide immediately, who will make every reasonable effort to resolve the issue. If the matter cannot be resolved locally, please contact Pure Nomad Ltd at sales@purenomadadventures.com. Should the problem remain unresolved, and you wish to escalate your complaint, you must provide formal written notice to us via email within 28 days of the end of your tour. Your notice should include your booking reference and all relevant details. Keeping your email clear and concise will help us quickly understand your concerns and respond more efficiently. Failure to follow this procedure may limit our and any supplier’s ability to investigate your complaint and may affect your rights under this contract.

24. CUSTOMER BEHAVIOUR

All participants are expected to conduct themselves in a responsible and acceptable manner and not to interfere with the enjoyment of others. If, in the opinion of Pure Nomad Ltd, the local guide, or any person in authority, your behaviour – or that of anyone in your party – causes, or is likely to cause, distress, danger, annoyance, damage to property, or disruption to transportation, we reserve the right to terminate your booking immediately. In such cases: 

  • Our liability to you and your party will cease; 
  • You and your party must leave the tour or associated arrangements immediately; 
  • No refunds will be provided for any unused accommodation or services, and we will not cover any expenses or costs incurred as a result of termination; and 
  • You and your party may also be required to cover any loss or damage caused by your actions. Each member of your party will be jointly and severally liable for such costs. Full payment for any damage must be made directly to the relevant supplier prior to departure. Failure to do so will make you responsible for any subsequent claims (including legal costs) brought against us and for all costs incurred in pursuing such claims. 

Pure Nomad Ltd cannot be held responsible for the actions or behaviour of other guests or third parties not connected to your booking or to us. 

25. ACKNOWLEDGEMENT OF RISK

By booking and participating in a tour with Pure Nomad Ltd, you acknowledge that adventure travel and the services we provide carry inherent risks to your health, safety, and property. You confirm that you have considered these risks and voluntarily accept full responsibility for them. You release Pure Nomad Ltd from any claims, liability, or legal action arising from injury, illness, loss, damage, or death resulting from the risks associated with travel, including participation in adventure activities, travel to remote or developing regions, or other activities arranged or offered by Pure Nomad Ltd. You must complete the required participation waiver (“the Waiver”) before the start of your tour. You can view our Waiver of Liability on our website here. A copy will also be sent to you for electronic signature once your tour or tailor-made adventure booking is confirmed. The Waiver of Liability must be accepted and signed by all participants in the booking (or, where applicable, their parent/guardian). We reserve the right to cancel a booking where a participant fails to sign the Waiver of Liability.  

The level of risk depends on the nature of the tour, activities involved, and destinations visited. Tours may include physically demanding or high-risk activities, carriage by watercraft, or travel through areas with limited medical facilities or variable standards of accommodation, hygiene, and transport. 

Pure Nomad Ltd does not provide guidance on local laws, customs, weather, or specific safety conditions. It is your responsibility to assess the risks, consider your own physical capabilities, and accept responsibility for any consequences arising from your participation. 

You must comply with all laws and regulations in the countries you visit.  

You must follow all safety instructions and use any provided safety equipment, including seatbelts, helmets, harnesses, or flotation devices. Pure Nomad Ltd and its suppliers will not be liable for losses resulting from your failure to adhere to safety guidance. 

Adventure tours may also involve political, environmental, cultural, or geographical conditions that present additional hazards and physical challenges. While Pure Nomad Ltd reviews safety conditions and provides relevant information, inherent risks remain, and you are responsible for taking reasonable precautions at all times. Your participation indicates your understanding and acceptance of these risks. 

Alcohol Use 
If you choose to consume alcohol during your tour, you accept responsibility for your own safety and the security of your belongings. Pure Nomad Ltd will not accept liability for incidents occurring while you are under the influence. 

26. OUR RESPONSIBILITIES
 As the organiser under the Package Travel and Linked Travel Arrangements Regulations 2018, Pure Nomad Ltd accepts responsibility for properly providing or arranging the services included in your confirmed package, as specified on your booking confirmation. If we or our suppliers negligently perform or arrange these services and fail to resolve your complaint within a reasonable time, resulting in a significant impact on your enjoyment of the package, you may be entitled to an appropriate refund or price reduction. You must notify us promptly of any failure or improper performance of included services. Any refund or reduction will take into account all relevant factors, including adherence to the complaints procedure and the degree to which negligence by us, our employees, or our suppliers affected the overall enjoyment of your tour. It is your responsibility to demonstrate any negligence if making a claim. 

Pure Nomad Ltd will not be liable for any loss, injury, illness, death, damage, expense, or other claim caused by: 

  • Acts or omissions of the affected person; 
  • Acts or omissions of third parties not connected with the services provided, which were unavoidable or extraordinary; or 
  • Events of Force Majeure.  

Limitations of Liability
Our liability to you, and all participants in your booking, is (to the fullest extent permitted by law) limited as follows:  

  • For luggage, personal effects, and money, to the excess on your travel insurance policy, as you are required to maintain adequate coverage for these items; 
  • For other claims not involving injury, illness, or death, to an amount equal to three times the price paid by or on behalf of the affected person(s) for the relevant tour, and only where the tour has completely failed to provide any benefit. 

For international travel and accommodation, our liability to you and each participant in your booking is limited in accordance with applicable international conventions, including the Warsaw/Montreal Conventions (air travel), Athens Convention (sea travel), Berne/Cotif Convention (rail travel), and Paris Convention (hotels). Copies of these conventions are available on request. Terms and conditions of carriers or transport providers apply to your journey and are incorporated into your contract by reference provided you have been notified of them at the time of booking. 

For claims under the Denied Boarding Regulation 2004, any liability we may have will be limited to the remedies provided under the Regulation. 

Any compensation made by us under these Terms will be reduced by any amount you, or the affected person, have received or are entitled to receive from transport providers or accommodation suppliers for the same claim, or from any insurance provider. 

Excluded liability
Pure Nomad Ltd is not liable for losses that could not reasonably have been foreseen based on information provided prior to booking; or any loss relating to business use, nor for any incidental, punitive, indirect, special or consequential damage, loss or expenses, including but not limited to any loss of business, contracts, revenue, or profits, any business interruption, security breach, loss of data, loss of goodwill or reputation or other pecuniary loss suffered by you or any member of your party, even if Pure Nomad Limited or any of its personnel have been advised of their possible existence.  

To the extent that the provisions of any applicable law shall impose restrictions on the extent to which liability can be excluded under these Terms including, for the avoidance of doubt, the provisions of sections 3, 6 and 11 of the Unfair Contract Terms Act 1977 in the UK (and its equivalent in any other jurisdiction) relating to the requirement of reasonableness, the exclusions set out in this clause shall be limited in accordance with such restrictions. However, any exclusions of liability that are not affected by such restrictions shall remain in full force and effect. 

Nothing in these Terms shall exclude or limit a party’s liability for fraud or intentional unlawful conduct by a party, or death or personal injury resulting from a party’s negligence. 

Pure Nomad Ltd is not responsible for services not included in your booking including excursions, any service, any facility or optional activities arranged independently while on tour.  

Claims procedure
Claims must be submitted strictly in accordance with the complaints procedure outlined in these Terms. Any payments made require the affected person (or a parent/guardian for minors) to assign rights to pursue third parties to Pure Nomad Ltd or its insurers and to provide reasonable assistance. 

Alternative Arrangements for Unavoidable and Extraordinary Circumstances
If you are unable to return to your departure point on the scheduled date due to unavoidable and extraordinary circumstances, we will, where possible, provide necessary accommodation of a comparable standard for up to three nights per person. This limit does not apply to individuals with reduced mobility, pregnant women, unaccompanied minors, or persons requiring specific medical assistance, provided we were notified in advance. 

For the purposes of this clause, “unavoidable and extraordinary circumstances” include warfare, acts of terrorism, significant risks to human health (including outbreaks of serious disease at the travel destination), and natural disasters such as floods, earthquakes, or adverse weather that make it impossible to travel safely to or from your departure point. 

27. OPTIONAL EXTRAS

“Optional Extras” include any activity, transport, meal, product, or service that is not expressly included in the itinerary or price of your Tour and does not form part of the core Tour package. Any assistance provided by a Pure Nomad Ltd representative in recommending, arranging, booking, or advising on Optional Extras is at your request only. Pure Nomad Ltd makes no representations or warranties regarding Optional Extras and expressly disclaims all liability for any loss, damage, inconvenience, injury, or other issues arising from participation in or use of Optional Extras. By booking or taking part in Optional Extras, you release Pure Nomad Ltd from any claims, causes of action, or liability related to them. 

We may make suggestions for Optional Extras you can partake in during your tour, including on our website or while on the tour. Any excursions, optional tours, or additional activities booked during your tour are considered Optional Extras. Your contract for these activities is directly with the third-party operator providing them, and Pure Nomad Ltd is not responsible for their delivery or for any incident, injury, loss, or inconvenience that occurs during their provision. You acknowledge that any risk, loss, injury, illness, death, emotional or psychological harm, or property damage resulting from participation in Optional Extras is the sole responsibility of the third-party provider. Please refer to the itinerary to confirm which activities are included in your Tour; any activity marked as optional is operated independently and is not part of your contract with Pure Nomad Ltd. 

28. FINANCIAL PROTECTION

Pure Nomad Ltd is a member of Protected Trust Services (Membership Number: 6409). Your payments are held in a secure and ring-fenced HSBC trust account that is managed by external trustees. You can verify our membership by contacting Protected Trust Services (PTS) directly.  
 
29. PASSPORT, VISA, IMMIGRATION AND HEALTH REQUIREMENTS 

It is your responsibility to ensure that you meet all passport, visa, health, and immigration requirements for your trip. This includes: 

  • Holding a valid passport. 
  • Obtaining all necessary travel documents, including visas, permits, certificates (e.g., vaccination or medical certificates), and insurance policies. 

Pure Nomad Ltd provides general guidance only. You must check the current requirements for your personal circumstances with the relevant Embassies, Consulates, and medical professionals well in advance of travel, as regulations can change. 

Passport validity
Most countries require passports to be valid for at least six months after your return date. If your passport is nearing expiry, check with the Embassy of your destination country. Further guidance for UK passports is available from the Passport Office: 0870 5210410 or https://www.gov.uk/browse/citizenship/passports. Up-to-date travel advice can be obtained from the Foreign, Commonwealth & Development Office: https://www.gov.uk/travelaware. Non-British passport holders, including other EU nationals, should verify requirements with the Embassy, High Commission, or Consulate of their destination and any transit countries. 

Responsibility & liability 

  • You are solely responsible for ensuring that you have the correct travel documents. 
  • Pure Nomad Ltd is not liable if you are unable to travel or suffer any loss due to failure to comply with passport, visa, immigration, or health requirements. 
  • You agree to reimburse us for any fines, fees, or other costs incurred as a result of your non-compliance. 
  • No refund will be given for a tour you cannot undertake because of incomplete or invalid documentation. 

Pure Nomad Ltd does not provide advice or guarantee the accuracy or completeness of information regarding visas, vaccinations, climate, clothing, baggage, or special equipment. You acknowledge that you are responsible for verifying all requirements and accept that we are not liable for any errors, omissions, or reliance on this information. 

30. PROMPT ASSISTANCE

If you encounter difficulties while on your tour, we will provide prompt and appropriate assistance in the circumstances. This may include guidance on local health services, authorities, consular support, communication options, or alternative travel arrangements.  

Where the assistance required does not arise from any fault or negligence of Pure Nomad Ltd, our employees, or our suppliers, we will not be responsible for the costs of alternative travel arrangements or related assistance unless otherwise provided for under these Terms. Certain suppliers, airlines, or transport providers may, at their discretion, cover or provide accommodation or refreshments, and any claims should be made directly to them. 

Unless otherwise agreed, we will not cover any expenses you incur without our prior approval. We also reserve the right to charge a fee for assistance if the difficulty arises intentionally or through negligence by you or any member of your party. 
 
31. FLIGHTS AND INTERNATIONAL ARRIVALS 
 
If you or any member of your party misses a flight or other transport connection not included in your tour, experiences a cancellation, or is delayed by more than three hours for any reason, you must contact the airline or transport provider directly and without delay. As flights or other external transport connections are not included in our package, Pure Nomad Ltd accepts no liability for any such delays, cancellations, or disruptions. Certain transport providers or airlines may, at their discretion, offer refreshments or accommodation, and any claims should be made directly to them. You should notify us as soon as possible of any delays or interruptions affecting your arrival to the tour destination. 

Subject to any other rights you may have under these Terms or at law, if you miss the departure of the tour, or any part of the tour (for example, a scheduled transfer or trip included in the booking) for any reason (other than due to a delay caused by us) then we will not be required to refund the part of the service you have missed. You may be able to join (or re-join as the case may be) the tour, at your own expense, however this may not be possible due to various factors and whilst we will use reasonable endeavours to assist you (at your cost) we will not be liable for any costs or expenses you incur, or loss you suffer, to join or rejoin the tour in these circumstances. If you cannot, or do not, join the tour any refund will be calculated in accordance with these Terms, taking into account any services already provided or costs incurred. 

In some circumstances, such as unavoidable and extraordinary circumstances pursuant to clause 16, you may have rights or entitlements to full or partial refunds.  

Foreign Office Advice
It is your responsibility to check and consider the Foreign Office travel advice for the countries and regions included in your itinerary. If official advice recommends avoiding or leaving a destination, this may constitute a Force Majeure event (see clause 19). 

32. EMAIL MARKETING AND CUSTOMER DATA MANAGEMENT

When you book a Pure Nomad Ltd tour, whether online or via our sales team, we may add you to our mailing list for similar products and services unless you have expressly opted  You have the right to access your personal data and unsubscribe at any time. Please refer to our Privacy Policy for full details. 

33. IMAGES AND MARKETING

During your tour, photographs or videos may be taken by Pure Nomad Ltd or its representatives that may include your image or likeness. You consent to our use of such photographs or videos for marketing and promotional purposes (for example on our website, social media, email communications, or printed materials), on a royalty-free and worldwide basis. 

We always aim to use images respectfully and appropriately. If you would prefer not to appear in any photographs or promotional material, please let your local guide or our team know at any time and we will take reasonable steps to respect this.  

This clause does not apply to photographs or videos taken by other participants for their personal use, over which we have no control. 

34. PRIVACY POLICY

We collect and process your personal information in order to provide our goods and services and any associated products or services you have booked. Our Privacy Policy, available at https://purenomadadventures.com/privacy-policy/ is incorporated into these Terms by reference. By providing any personal information to us, you consent to the collection, use, and disclosure of your data in accordance with this Privacy Policy. 
 
35. ADDITIONAL TERMS FOR TAILOR-MADE TOURS 
 
These terms apply exclusively to bookings or travel on Tailor-Made Tours with Pure Nomad Ltd. 

Price Validity 
Upon receipt of your Tailor-Made booking request, Pure Nomad Ltd will provide a quote for the chosen tour. Prices are valid only until the date specified in the quote. After this date, Pure Nomad Ltd reserves the right to issue a revised quote. Any changes to the Tailor-Made itinerary – including alterations to travel dates or the number of participants – may result in a revised quote. 

Payment and Cancellation 
Bookings for Tailor-Made Tours are only confirmed when you pay the deposit and we confirm by email. Full payment for Tailor-Made Tours is due no later than 60 days prior to the departure date of the first product or service on your itinerary. If payment is not received by this date, Pure Nomad Ltd may issue a revised quote, adjust the rate payable, or treat the booking as cancelled, retaining the deposit paid as a cancellation fee. For bookings made within 60 days of the departure date of the first product or service, the full amount is payable at the time of booking. 
 
You may cancel your booking by providing written notice to Pure Nomad Ltd. Applicable cancellation fees will be determined based on the date the notice is received and processed in accordance with the relevant clauses in these Terms. 

Deposit Terms 
A non-refundable deposit of £200 per person per Tailor-Made Tour is required at the time of booking. For bookings made within 60 days of the first departure, full payment is due immediately. Deposits for Tailor-Made Tours cannot be transferred to any other Pure Nomad Tour. 

Alterations to Tailor-Made Tours 
If you wish to change any part of your booking after the confirmation invoice has been issued, you must notify us in writing as soon as possible. Requests must be submitted by the first named person on the booking. While we will endeavour to accommodate reasonable changes, we cannot guarantee that all requests can be met. Any approved changes will incur an administration fee of £50 per change, as well as any costs incurred by us or our suppliers. Costs may increase closer to the departure date, so early notification is recommended. If we are unable to accommodate your request and you do not wish to proceed with the original booking, the situation will be treated as a cancellation by you.  

You may request to transfer your Tailor-Made booking to another person who meets all requirements of the trip, provided that you give Pure Nomad Ltd notice in writing at least 61 days before departure. 
A £50 administrative fee will apply to each transfer, together with payment of any difference in the total trip price, including where the original booking was made at a discounted or promotional rate. 

Due to the highly customised nature of Tailor-Made itineraries – and the requirement for permits, tickets, and other documentation issued in individual traveller names – transfers are not permitted within 60 days of departure and may, in some cases, not be possible at any stage if key arrangements are non-transferable. 

Cancellation Terms for Tailor-Made Tours 

  • For cancellations made 60 days or more prior to the tour departure, the £200 deposit per person will be retained by Pure Nomad Ltd in accordance with these Terms. Any remaining payments made for the cancelled tour will be refunded. 
  • For cancellations made less than 60 days prior to the first departure, no refund will be payable.

36. ACCEPTANCE OF TERMS AND CONFIRMATION OF AGREEMENT

By completing a booking with Pure Nomad Ltd, you confirm that you have read, understood, and agreed to these Booking Terms & Conditions, our Waiver of Liability and our Privacy Policy and any other written information provided prior to booking confirmation (the Terms).  

Acceptance of the Terms takes effect upon completion of your booking and payment of the deposit or full balance. The date of payment will serve as timestamp evidence of your acceptance and the formation of a binding contract with Pure Nomad Ltd. You acknowledge that these Terms form a legally binding agreement between you (the traveller) and Pure Nomad Ltd, effective from the date your payment is received. 

Where a booking is made on behalf of additional participants, the first named person on the booking confirms that they have the authority to accept these Terms on behalf of all persons listed, and that all members of the party understand and agree to be bound by them. 

If a booking is made offline (for example, by email or telephone), a copy of these Terms & Conditions will be provided, and acceptance will be deemed confirmed upon payment of the deposit or full balance. 

37. DOCUMENT CONTROL AND AMENDMENT

These Booking Terms & Conditions are issued by Pure Nomad Ltd and apply to all bookings made on or after 23/01/2026. 

Pure Nomad Ltd reserves the right to amend or update these Terms & Conditions at any time. Any revisions will take effect once published on our official website,
www.purenomadadventures.comand will apply to new bookings made after the date of publication. 

For clarity, the version of the Terms & Conditions in effect at the time of your payment will govern your contract with Pure Nomad Ltd.
